Terms of Service

1. Acceptance of Terms

By accessing or using any website, mobile application, software product, or service ("Services") provided by MadLang, LLC ("MadLang," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use our Services.

These Terms constitute a legally binding agreement between you and MadLang, LLC, a limited liability company organized under the laws of the State of Texas. By creating an account, downloading our applications, or otherwise using our Services, you represent that you are at least 18 years of age and have the legal capacity to enter into this agreement.

2. Description of Services

MadLang develops and operates software products including mobile applications, artificial intelligence solutions, and software-as-a-service ("SaaS") platforms. Our Services may include, but are not limited to:

  • Mobile applications available through third-party app stores (including the Apple App Store and Google Play Store)
  • Web-based SaaS platforms and tools
  • AI-powered features, integrations, and products
  • APIs and developer tools
  • Related support, documentation, and content

Specific features, functionality, and pricing may vary by product and are subject to change. Additional terms or agreements may apply to individual products or subscriptions and will be presented to you at the time of purchase or enrollment.

3. Accounts and Registration

Some Services require you to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You must notify us immediately at support@madlang.ai if you suspect unauthorized access to or use of your account.

We reserve the right to suspend or terminate accounts that contain false or misleading information, or that violate these Terms.

4. Subscriptions and Payments

Certain Services are offered on a subscription basis. By subscribing, you authorize MadLang to charge the applicable fees to your selected payment method on a recurring basis until you cancel. Subscription terms, pricing, and billing cycles are disclosed at the point of purchase.

You may cancel your subscription at any time through your account settings or by contacting us. Cancellations take effect at the end of the current billing period. Unless otherwise required by applicable law, fees already paid are non-refundable.

For purchases made through third-party app stores, the billing and refund policies of that platform (such as Apple or Google) apply in addition to these Terms.

5. Intellectual Property

All content, software, code, designs, trademarks, logos, and other materials associated with our Services ("MadLang Materials") are the exclusive property of MadLang, LLC or its licensors and are protected by United States and international intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for your personal or internal business purposes. You may not:

  • Copy, modify, distribute, sell, or lease any part of the MadLang Materials
  • Reverse-engineer, decompile, or disassemble any software included in our Services
  • Remove or alter any proprietary notices, labels, or marks
  • Use our trademarks, trade names, or branding without prior written consent
  • Sublicense or transfer your rights under these Terms to any third party

6. User Content and Data

You retain ownership of any content, data, or materials that you submit, upload, or transmit through our Services ("User Content"). By submitting User Content, you grant MadLang a worldwide, non-exclusive, royalty-free license to use, process, store, and display that content solely as necessary to provide and improve the Services.

You represent and warrant that you own or have the necessary rights to submit your User Content and that it does not infringe the intellectual property or other rights of any third party.

7. User Responsibilities and Acceptable Use

You agree to use our Services in compliance with all applicable laws and regulations. You must not:

  • Use the Services for any unlawful, fraudulent, or malicious purpose
  • Interfere with or disrupt the integrity, performance, or security of the Services or any related systems
  • Attempt to gain unauthorized access to any part of the Services, other accounts, or connected networks
  • Transmit viruses, malware, or any code designed to harm or compromise the Services
  • Use automated systems (including bots, scrapers, or crawlers) to access the Services without our written permission
  • Resell, redistribute, or commercially exploit the Services without authorization
  • Violate the rights of other users or third parties

We reserve the right to investigate and take appropriate action against any violations of these Terms, including suspension or termination of access and reporting to law enforcement authorities where appropriate.

8. Third-Party Services

Our Services may integrate with or contain links to third-party platforms, services, or content. These third-party services are governed by their own terms and privacy policies. MadLang does not endorse, control, or assume responsibility for third-party services, and your use of them is at your own risk.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, MADLANG DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS. WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT OR OUTPUT GENERATED THROUGH THE SERVICES, INCLUDING AI-GENERATED CONTENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MADLANG, LLC, ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, REVENUE, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, REGARDLESS OF THE THEORY OF LIABILITY.

TO THE EXTENT PERMITTED BY LAW, MADLANG'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO MADLANG FOR THE APPLICABLE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100 USD).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

11. Indemnification

You agree to indemnify, defend, and hold harmless MadLang, LLC and its officers, directors, members, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, or your infringement of any third-party rights.

12. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. You may stop using the Services at any time by deleting your account or uninstalling our applications.

Upon termination, your right to use the Services ceases immediately. Sections of these Terms that by their nature should survive termination shall continue in full force and effect, including but not limited to intellectual property provisions, disclaimers, limitations of liability, indemnification, and governing law.

13. Changes to These Terms

We may update these Terms from time to time to reflect changes to our Services, legal requirements, or business practices. When we make material changes, we will update the "Effective Date" at the top of this page and, where appropriate, provide notice through the Services or by email.

Your continued use of the Services following the posting of revised Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must discontinue use of the Services.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict-of-law principles. Any legal action or proceeding arising out of or related to these Terms or the Services shall be brought exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of such courts.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable while preserving its original intent.

16. Entire Agreement

These Terms, together with any additional terms presented for specific products or services, constitute the entire agreement between you and MadLang, LLC regarding your use of the Services. These Terms supersede all prior agreements, representations, and understandings relating to their subject matter.
